September 12th 2008

Lil Wayne’s attorney is trying get the rapper’s New York gun case thrown out of court. The “New York Daily News” reports Stacey Richman told the Manhattan Supreme Court that she believes police didn’t have the right to search Weezy’s tour bus back in July 2007. Officer Diane Hornung testified earlier this week that she smelled pot coming from Wayne’s bus, and that gave her probable cause for the search. However, Richman claims court documents prove Hornung was several blocks away assisting in the arrest of rapper Ja Rule on gun charges. The arrests came after Weezy had finished a concert at New York City’s Beacon Theatre. If convicted, Wayne faces a mandatory sentence of three-and-a-half years behind bars. The rapper is also facing gun and drug charges in Yuma, Arizona, stemming from an arrest in January.
