Real Housewives of Atlanta reality star, Kandi Burruss and former cast member Kim Zolciak-Biermann are now facing each other in court. Kandi is suing Kim for not properly compensating her for the three year old song, “Don’t Be Tardy For The Party.”
Kandi and co-writer of the song Rodney Richards have filed paperwork in a Georgia earlier this week and stated:
“Damages for copyright infringement due to Defendants’ unauthorized and unlawful licensing, distribution and sale of Plaintiffs’ creative works, namely a sound recording embodying a performance of a musical composition entitled ‘Tardy for the Party. ‘ “
Kim and oldest daughter took to twitter to vent about the situation with Kandi. During Season 3 of RHOA in 2011, Kandi had stated that she was only paid a one time fee of $4,000.
“Normally, I would get sync license fees every time the song plays, but I gave the show a gratis, I know Kim was new to the music industry so I don’t feel like she was purposely trying to wrong me. I just think she was misinformed.”
This week Kim responded to the accusations to TooFab.com:
“This is nothing short of a publicity stunt, I find this lawsuit funny yet sad. Coming after me now and this song is 4 years old? I have in fact overpaid Kandi and have documents to prove it and my legal team will handle this accordingly.”
BOTH ladies will be on the reunion special… This should be interesting. In other news the ladies are gearing up for their spin off shows on Bravo to premier in April, Don’t Be Tardy and The Kandi Factory.

Kandi it is about time. This is business not personal and why in the world would you allow Kim to beat you out of what you worked for and deserve. If you allow her to do that, then others will think they can as well. Riley hears what you say, she believes what you do. Better later than never. I have much more respect for you.
I love kandi but I would have to agree…why wait 4 years to NOW sue Kim for the song….my opinion.

yes I do question why Kandi took such a long time to address this issue in litigation but I see she did it when she felt the time was right… and Kim is wrong for not compensating her properly for go way and beyound out her way to help with a song… I hope Kandi sue kim for legal fees and etc kim is dead wrong… Andy ask kandi last season during the reunion did kim pay her she wave her hand at him as if she didnt want to go into detail but its all out in public now… ha ha kim
